Marketplates UAP

Marketplates at all times strives to maintain a safe, respectful, and lawful environment.

This acceptable use policy (UAP) sets out what you can and cannot do when you interact with our sites and use our services.

“We”, “us” and “our” means Marketplates Pty Ltd ABN 14 687 870 524.

The services we provide may only be used for lawful purposes, and for purposes set out in our Terms of Use. By using our services you agree to comply with all applicable laws, rules, and regulations that apply to your use, including any requirements included in this UAP and our Terms of Use. Any conduct of yours which in our opinion violates this UAP and/or our Terms of Use in any manner may result in removal of your Marketplates account and/or access to our services with or without notice.

Your Conduct

When you access our services you agree:

• to treat other users with respect;
• not to engage in harassment, hate speech, bullying, or targeted abuse of any kind;
• not to use Marketplates (and its sites and services) for any unlawful purposes;
• that you are responsible for complying with all laws and regulations that apply to your use of Marketplates, including any laws and regulations relating to the transfer of number plates and any consumer protection laws;
• to only list rights to display and number plates which you lawfully own or have the legal right to transfer or sell, in accordance with relevant state or territory laws;
• not to engage in activity that is harmful to others, or that would subject Marketplates to liability;
• that certain content or combinations (despite an approved original sale) may be prohibited from being listed for sale due to legal, safety, and ethical reasons. Prohibited plates include but are not limited to those which:
  • contain obscene or indecent content, such as profanities, sexually explicit references, or crude terms;
  • include offensive or hateful content, for example plates which insult, demean, discriminate or negatively target a person or group of people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected attributes;
  • incite illegal or violent conduct, including plates which promote or glorify criminal activity, violence, or unsafe behaviour, not limited to reckless driving and criminal organisations;
  • contain references to or promote illegal drugs, narcotics, or related paraphernalia;
  • reference weapons and extremist ideologies, such as terrorism;
  • could be mistaken for government-issued plates or that impersonate law enforcement or emergency services;
  • infringe intellectual property rights, such as trademarks and copyright;
  • falsely imply endorsement or connection with a company, charity, or public figure;
  • could be considered offensive toward governmental departments or figures;
  • might cause confusion as to their identification; or
  • are not capable of being transferred by law.
• not to engage in or attempt to engage in the sale of any rights/plates listed on Marketplates outside of Marketplates or Escrow.com, for example by selecting a listing, identifying a buyer and then seeking to complete a sale privately;
• not to engage in fraudulent behaviour, such as creating multiple accounts in order to manipulate listings, including by bidding on your own listing or coordinating with others to drive up the price of a listing;
• not to use Marketplates and its services to send spam or unsolicited advertising;
• not to crawl, scrape, or use any automated means to extract data from Marketplates;
• not to distribute or publish pornography or other adult related content;
• not to interfere with or attempt to interfere with the normal operation of Marketplates and its systems, such as through the deployment of malware, viruses, worms, Trojan horses or other malicious code;
• not to upload or post sensitive or personal information (whether your own or that of others), such as phone numbers, addresses, and email addresses;
• not to misrepresent your identity, plate ownership, or authority to act on behalf of a third party and not to engage in any unauthorised use of content owned by another person, for example uploading an image of a plate you do not own or do not have consent to upload;
• not to upload images of number plates that are fabricated, digitally manipulated, or misrepresent the actual plate being offered.

Enforcement

Marketplates reserves the right to review any conduct and remove any content that violates this AUP or our Terms of Use. We may suspend or terminate accounts for serious or repeated violations. In particular, Marketplates reserves the right to permanently suspend or ban users who engage in repeated or serious breaches of this AUP, including attempted fraud, impersonation, or violation of state vehicle registration regulations.

We will generally notify you if we remove your content or suspend your account, and provide reasons for taking such action, unless we are legally prevented from doing so or providing such information would cause harm.

Marketplates Communications

By using the MarketPlates chat or messaging tools, you agree to comply with this AUP and our Terms & Conditions. Sharing personal contact details (including but not limited to name, phone numbers, email addresses, and physical addresses) through chat is strictly prohibited and will be automatically filtered.

Any attempt to bypass this restriction — including repeated efforts to share such information — will be considered a violation of this policy. Users who engage in these activities may have their accounts suspended or permanently banned from the site.

Contact details will be shared securely through Escrow.com only after offers are accepted.

Reporting Violations

We encourage all Marketplates users to report any content or behaviour they believe might violate this AUP, our Terms of Use and any applicable law or regulation.

Any investigation conducted by Marketplates into alleged breaches of our services will be conducted promptly and in strict confidence.

Users are at all times responsible for their own conduct, and Marketplates is not liable whatsoever for user-provided content and/or user conduct.

Amendment

This AUP may change from time to time without notice to you, with any amended version made available on our website.
